smaXtec animal care GmbH (hereinafter referred to as smaXtec) handles the personal data of its customers with great care. The following privacy policy is intended to give you an overview of how smaXtec uses the personal data of its customers and business partners and the measures smaXtec takes to protect such personal data.

1. Collecting, using and processing personal data:

smaXtec collects personal data only to the extent that the data is needed to fulfil the contract concluded with you or if you give your consent to the collection of data. Personal data provided by you will not be used, processed or disclosed beyond the permissible scope provided by law or beyond the scope of your declaration of consent. We will only disclose your data to third parties if we are required and/or entitled to do so by law, official or court orders, or by virtue of an order placed by you. The data about you that is to be stored by us within the scope of performing the contract include contact details (name, address, electronic contact details), customer information (data on the contractual relationship and customer contacts), operational information (data on the operation managed by you) and financial information (data concerning the billing and payment of services we provide to you). This website uses the open source web analytics service Matomo, (formerly Piwik). Matomo sets so-called ‘cookies’. The information generated by the cookie about the use of this website is stored exclusively on the server operated by our agency. The IP address is anonymized before storage.

Matomo cookies remain on your terminal device until you delete them. The information generated by the cookie about the use of this website is only visible to our agency (host of our website) and us. We have concluded a GDPR -compliant order processing contract with the agency.

Facebook Pixel

We have concluded a contract with Facebook Ireland, but it may nevertheless happen that Facebook Ireland transfers personal data to Facebook USA. For the USA, there is currently no adequacy decision by the EU Commission within the meaning of Article 45 (1), (3) of the General Data Protection Regulation (GDPR). This means that the EU Commission has not yet positively determined that the country-specific data protection level of this country corresponds to that of the European Union based on the GDPR § 4 (appropriate safeguards).

The GDPR requires so-called suitable guarantees for a data transfer to a third country or to an international organization, Art. 46 (2), (3) GDPR. Such are not present for the above-mentioned country of destination.

Eventual risks that cannot currently be excluded for you as a data subject in connection with the aforementioned information are in particular:
1. Your personal data could possibly be disclosed by Facebook USA to other third parties (e.g.: US authorities) beyond the actual purpose of fulfilling the order.
2. you may not be able to sustainably assert or enforce your rights of access against Facebook USA.
3. there may be a higher probability that incorrect data processing may occur because the technical organizational measures for the protection of personal data do not fully meet the requirements of the GDPR in terms of quantity and quality.

With your consent to the processing of (advertising and marketing) cookies, you explicitly consent to the transfer of data to the USA. You can revoke this consent at any time informally by e-mail. The data processing that took place before the revocation of your consent is not affected by the revocation and therefore legally compliant.

When a user calls up a website of this offer that contains such a plugin, his browser establishes a direct connection with the Facebook servers. In addition to the email address and other data you provide, such as first and last name, Mailchimp collects the following personal data using cookies and other tracking methods: Information about your terminal device (IP address, device information, operating system, browser ID, information about the application you use to read your emails and other information about hardware and internet connection.
